1. Introduction and Acceptance of Terms
Welcome to Yoko. These Terms of Service ("Terms", "Agreement") constitute a legally binding contract between you ("User", "you", "your") and Yoko ("Yoko", "we", "our", "us"), governing your access to and use of the Yoko mobile application, website, and all associated services (collectively, the "Services").
BY DOWNLOADING, INSTALLING, REGISTERING FOR, OR USING THE YOKO APPLICATION, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS IN THEIR ENTIRETY. If you do not agree to any part of these Terms, you must immediately discontinue use of the Services and uninstall the application.
These Terms should be read in conjunction with our Privacy Policy, which is incorporated herein by reference and forms an integral part of this Agreement. In the event of any conflict between these Terms and the Privacy Policy, these Terms shall prevail with respect to matters of user conduct and service usage.
2. Eligibility and Age Requirements
2.1 Minimum Age
- You must be at least 18 years of age to access or use Yoko. Yoko is not intended for, directed at, or designed for individuals under the age of 18.
- By registering an account, you represent that you are 18 years of age or older. Providing false age information constitutes a material breach of these Terms and may result in immediate account termination.
- We reserve the right to implement identity and age verification procedures at any time, including requiring submission of government-issued identification. Failure to complete verification may result in restricted access or account suspension.
2.2 Legal Capacity
- You must have the legal capacity to enter into a binding contract under the laws of your jurisdiction.
- You must not be prohibited from using the Services under the laws of your country of residence or any applicable jurisdiction.
- You must not have been previously banned, suspended, or permanently removed from Yoko or any related service for violations of our policies.
2.3 Geographic Restrictions
- Yoko is available globally; however, certain features may be limited or unavailable in specific jurisdictions due to legal or regulatory restrictions. You are responsible for ensuring your use of the Services complies with local laws and regulations in your country.
3. Account Registration and Security
3.1 Account Creation
- You agree to provide accurate, current, and complete information during the registration process, including a valid email address or phone number, your legal name or preferred display name, and a date of birth confirming you are at least 18 years old.
- You may not create an account using the identity of another person or entity, or using false information for the purpose of misrepresenting your identity.
- Each individual may maintain only one active account. The creation of multiple accounts to evade bans, manipulate platform features, or otherwise circumvent these Terms is strictly prohibited.
3.2 Account Security
- You are solely responsible for maintaining the confidentiality of your account credentials. You agree not to share your login credentials with any third party.
- You must notify Yoko immediately at service@yoko.blog if you become aware of any unauthorized access to or use of your account.
- Yoko reserves the right to require you to change your password or other credentials at any time if we believe your account security has been compromised.
3.3 Account Verification
- Yoko may offer or require email or phone number verification as part of the registration process. Verified accounts may receive additional platform trust signals and feature access.
- We may, at our sole discretion, implement additional verification steps including but not limited to photo verification to confirm your identity matches your profile.
4. Description of Services
Yoko is a live video calling and social discovery platform that enables adults to connect with new people worldwide.
4.1 Core Features
- 1-on-1 Video Calls (Recommended Users): Browse a curated feed of user profiles and initiate live face-to-face video calls with users of your choice with a single tap.
- Random Global Video Matching: Initiate a spontaneous 1-on-1 live video call with a randomly selected user from anywhere in the world.
- In-App Text Chat: Send and receive text messages with matched users or users you have connected with through video calls.
- User Profiles: Create and customize a personal profile including display name, profile photograph, bio, and interest tags.
4.2 Premium and Paid Features
- Yoko may offer optional premium features, virtual currency, subscription plans, and other paid enhancements. These are described further in Section 8.
4.3 Service Availability
- Yoko provides the Services on an "as available" basis. We do not guarantee uninterrupted or error-free access at all times.
- We reserve the right to modify, suspend, discontinue, or add new features to the Services at any time with or without prior notice.
5. User Conduct and Community Guidelines
5.1 Prohibited Conduct
- Harassing, threatening, bullying, intimidating, stalking, or abusing any other user.
- Transmitting any content that is sexually explicit, pornographic, or obscene.
- Impersonating any person or entity, or misrepresenting your identity.
- Soliciting personal information from other users for unauthorized purposes.
- Promoting or engaging in prostitution, escort services, or commercial sexual activity.
- Transmitting unsolicited commercial messages, spam, or pyramid scheme promotions.
- Attempting to gain unauthorized access to Yoko's systems or other users' accounts.
- Using bots, scripts, or automated tools to interact with other users or manipulate platform metrics.
- Engaging in any activity that violates applicable law or regulation.
5.2 Reporting Violations
- If you encounter a user or content that violates these guidelines, please use the in-app reporting feature available on all user profiles and during video call sessions.
- False or malicious reports submitted in bad faith may result in action against the reporting account.
6. User-Generated Content (UGC)
6.1 Content You May Share
- Profile photographs, display names, and biographical text.
- Text messages sent through the in-app chat feature.
- Images, short videos, or other media shared within chat conversations.
- Video and audio transmitted during live 1-on-1 video calls.
6.2 License Grant to Yoko
- By submitting content to Yoko, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, reproduce, display, distribute, and process that content solely as necessary to provide, operate, and improve the Services.
- This license does not transfer ownership of your content to Yoko. You retain all intellectual property rights in original content you create.
- This license terminates when you delete the content or close your account, subject to any retention obligations required by law.
6.3 Content Standards and Responsibilities
- You represent and warrant that you own or have obtained all necessary rights and permissions to submit any content you upload.
- You are solely responsible for the accuracy, legality, and appropriateness of all content you submit.
- You must not submit content that is defamatory, fraudulent, discriminatory, hateful, or that incites violence.
6.4 Copyright and Intellectual Property Infringement
- If you believe that content posted on Yoko infringes your copyright, please send a written notice to service@yoko.blog.
- Upon receipt of a valid infringement notice, Yoko will investigate and may remove or restrict access to the allegedly infringing content.
- Users who repeatedly infringe intellectual property rights will have their accounts terminated.
6.5 Content Moderation and Removal
- Yoko reserves the right to review, monitor, reject, remove, or disable access to any content that violates these Terms, our Community Guidelines, or applicable law.
- We may use automated systems, artificial intelligence, and human reviewers to detect and address policy violations.
- Users whose content is removed may appeal the decision by contacting service@yoko.blog within 30 days.
7. Intellectual Property Rights
7.1 Yoko's Intellectual Property
- The Yoko name, logo, taglines, application design, user interface, graphics, algorithms, source code, and all proprietary technology are protected by copyright, trademark, patent, and other intellectual property laws.
- You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes.
- You may not copy, modify, distribute, sell, sublicense, reverse engineer, decompile, or create derivative works based on any part of the Yoko platform.
7.2 Feedback and Suggestions
- If you provide us with feedback or suggestions regarding the Services, you hereby grant Yoko an irrevocable, perpetual, royalty-free license to use such feedback for any purpose without obligation or compensation.
8. Virtual Currency and In-App Purchases
8.1 Virtual Currency
- Yoko may provide a virtual currency system that allows users to purchase credits, coins, or tokens ("Virtual Currency") redeemable within the application.
- Virtual Currency has no real-world monetary value, cannot be exchanged for cash, and cannot be transferred between accounts unless explicitly permitted.
- Virtual Currency is purchased through the Google Play Store using real money. All prices include applicable taxes where required.
- Virtual Currency purchased is non-refundable except as required by applicable law.
- Yoko reserves the right to modify the value, availability, and redemption terms of Virtual Currency at any time with reasonable notice.
8.2 In-App Purchases and Subscriptions
- Premium features, subscriptions, and one-time purchases are processed through Google Play Billing or other authorized payment processors.
- Subscription plans automatically renew at the end of each billing period unless cancelled before the renewal date.
- Yoko does not have access to your payment card details. All payment data is handled directly by the applicable payment processor.
- You are responsible for any applicable taxes, duties, or charges associated with your purchases.
8.3 Recharge and Top-Up Process
- To recharge your Virtual Currency balance, navigate to the "Store" or "Top-Up" section within the Yoko app.
- In the event of a failed transaction, please allow up to 48 hours for credits to reflect before contacting support.
- Chargebacks initiated without first contacting Yoko support may result in account suspension pending investigation.
8.4 Refund Policy
- All purchases are generally non-refundable once the content has been delivered or consumed, except where required by applicable consumer protection laws.
- Subscription cancellations take effect at the end of the current billing period. No partial refunds are provided for unused portions.
- If you believe you have been charged in error, please contact service@yoko.blog within 14 days of the transaction.
- Refund requests related to Google Play purchases must comply with Google Play's refund policies.
8.5 Purchase Disputes
- In the event of a billing dispute, you agree to first contact Yoko's support team at service@yoko.blog before initiating any formal dispute or chargeback.
- Fraudulent chargebacks or abuse of the refund process may result in permanent account suspension.
9. Premium Subscription Terms and Cancellation
- Free Trial Offers: If offered, you may be required to provide payment information before the trial begins. If you do not cancel before the trial ends, you will be automatically charged.
- Billing Cycle: Subscriptions are billed monthly or annually as selected at the time of purchase.
- Feature Availability: Premium features are available only during an active subscription period.
- Price Changes: Yoko reserves the right to adjust subscription pricing with at least 30 days' prior notice.
- Cancellation Process: To cancel, navigate to Google Play > Subscriptions > Yoko and select "Cancel Subscription."
10. Protection of Minors and Child Safety Policy
10.1 Strict 18+ Age Requirement
- Yoko is exclusively designed for adults aged 18 and above. We implement technical age gates during registration and reserve the right to deploy additional verification mechanisms.
- Any user found to be under 18 will have their account immediately and permanently suspended.
- Users who knowingly assist a minor in accessing Yoko will be permanently banned.
10.2 Reporting Suspected Underage Users
- If you suspect another user is under 18, please report immediately using the in-app reporting feature or by emailing service@yoko.blog with the subject line "Underage User Report."
- All such reports are treated with the highest urgency and reviewed within 24 hours.
10.3 Zero-Tolerance Policy Toward Child Sexual Abuse and Exploitation (CSAE)
- Yoko maintains an absolute zero-tolerance policy toward all forms of CSAE.
- Any content depicting, facilitating, promoting, or distributing CSAM is strictly prohibited and will result in: immediate and permanent account termination; preservation of all relevant data for law enforcement; and mandatory reporting to NCMEC CyberTipline pursuant to 18 U.S.C. Section 2258A.
- Prohibited conduct includes: soliciting sexual images from minors; grooming minors; sharing or distributing CSAM; using the platform to arrange meetings with minors for sexual purposes; and creating or facilitating child sexual abuse content in any form.
- Yoko employs automated detection systems including hash-matching technology (PhotoDNA) and AI-based content classifiers to proactively identify and remove CSAM.
- Users who encounter any content related to child exploitation must report it immediately using the in-app reporting tool or by contacting service@yoko.blog.
10.4 Safe Design Principles
- Yoko's platform incorporates safeguards including mandatory date-of-birth entry, real-name profile requirements, and behavioral monitoring for anomalous activity patterns.
11. Privacy
Your privacy is important to us. Our collection, use, and handling of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.
- You have the right to access, correct, and delete your personal data as described in the Privacy Policy.
- Yoko does not sell your personal information to third parties for commercial advertising purposes.
- We take reasonable technical and organizational measures to protect your data against unauthorized access, loss, or misuse.
12. Third-Party Services and External Links
- Yoko does not control or take responsibility for the content, privacy practices, or terms of any third-party service.
- Your interactions with third-party services are solely between you and the relevant third party.
- In-app advertisements served by third-party ad networks are subject to those networks' own terms.
13. Real-Time Communication Standards
- You may not use video calls or chat features to transmit content that violates these Terms.
- You must not record, capture screenshots of, or reproduce any interaction with another user without their explicit prior consent.
- Yoko does not record or store the content of live video calls under normal operations. Where a session is reported, limited capture mechanisms may be activated solely for content moderation review.
- The quality of real-time calls may be affected by your internet connection, device performance, and network conditions.
14. Random Matching Feature
- Match sessions are random and Yoko does not guarantee the identity, background, conduct, or intentions of any user you are matched with.
- You use the random matching feature entirely at your own risk.
- You may end any match session at any time by tapping the disconnect button.
- Matching algorithms may take into account general location signals and content preferences.
- Yoko reserves the right to limit, modify, or discontinue the random matching feature at any time.
15. Content Moderation and Account Enforcement
15.1 Moderation Actions
- Content Removal: Content that violates these Terms may be removed without prior notice.
- Warning: For minor or first-time violations, we may issue a formal warning.
- Feature Restriction: We may restrict your access to specific features for a defined or indefinite period.
- Account Suspension: For moderate or repeated violations, your account may be temporarily suspended.
- Permanent Ban: For severe violations, your account will be permanently banned.
15.2 Appeals
- If you believe an enforcement action was applied in error, you may submit an appeal to service@yoko.blog within 30 days.
- Yoko will review all appeals in good faith, but our decisions are final in cases involving CSAE, illegal activity, or severe policy violations.
16. Account Suspension and Termination
16.1 Termination by You
- You may delete your account at any time through Settings > Account > Delete Account. Account deletion is permanent and cannot be undone.
- Deleting your account does not automatically cancel active subscriptions. You must cancel subscriptions separately through the Google Play Store.
16.2 Termination by Yoko
- Yoko may suspend or terminate your account at any time if we determine that you have violated these Terms, applicable law, or our Community Guidelines.
- Upon termination, your license to use the Services is revoked immediately. You may lose access to any Virtual Currency balance, premium features, or other account assets without compensation.
16.3 Survival of Terms
- Sections that by their nature should survive termination will remain in full force, including: Intellectual Property Rights, UGC license grants, Disclaimers, Limitation of Liability, Indemnification, and Governing Law.
17. Disclaimers of Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
- YOKO EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
- YOKO DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES.
- YOKO DOES NOT MAKE ANY WARRANTIES REGARDING THE CONDUCT, IDENTITY, OR INTENTIONS OF OTHER USERS.
- YOKO IS NOT RESPONSIBLE FOR ANY CONTENT TRANSMITTED OR POSTED BY USERS.
18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOKO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, data, business opportunities, or goodwill.
- Personal injury or emotional distress arising from interactions with other users.
- Unauthorized access to or alteration of your personal data.
- Any conduct or content of other users, whether online or offline.
- Any technical failures, service interruptions, or data loss.
IN NO EVENT SHALL YOKO'S TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO YOKO IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100.00).
19. Indemnification
You agree to indemnify, defend, and hold harmless Yoko, its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, losses, costs, and expenses arising out of or relating to:
- Your use of or access to the Services.
- Your violation of any provision of these Terms.
- Any content you submit, post, or transmit through the Services.
- Your violation of any applicable law or the rights of any third party.
- Your interactions with other users, whether online or offline.
20. Governing Law and Dispute Resolution
20.1 Informal Resolution
- Before initiating any formal dispute resolution, you agree to first contact Yoko at service@yoko.blog and attempt to resolve the dispute informally. Yoko will attempt to resolve within 30 days.
20.2 Binding Arbitration
- If informal resolution is unsuccessful, any dispute shall be finally resolved by binding arbitration. The arbitration shall be conducted in English.
20.3 Class Action Waiver
- TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST YOKO.
20.4 EU/EEA User Rights
- Nothing in these Terms limits your right as a consumer in the EU or EEA to bring claims before your local courts.
21. International Use and Export Compliance
- You may not use the Services in any jurisdiction where doing so is prohibited by law.
- You represent that you are not located in any country subject to comprehensive international sanctions.
- Users are solely responsible for ensuring compliance with applicable local laws.
22. Electronic Communications and Notices
By using Yoko, you consent to receive electronic communications from us, including in-app notifications, email communications, and push notifications (which you may opt out of through your device settings).
Notices from you to Yoko must be sent to service@yoko.blog.
23. Force Majeure
Yoko shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, pandemics, war, cyberattacks, or widespread infrastructure failures.
24. Changes to These Terms
Yoko reserves the right to modify or update these Terms at any time. When we make material changes, we will notify you by displaying a prominent notice within the app and sending a notification to your email address.
Your continued use of the Services after the effective date of any updated Terms constitutes acceptance. If you do not agree with the updated Terms, you must discontinue use and delete your account.
25. General Provisions
25.1 Entire Agreement
- These Terms, together with the Privacy Policy, constitute the entire agreement between you and Yoko.
25.2 Severability
- If any provision of these Terms is found invalid or unenforceable, that provision will be modified to the minimum extent necessary, and all other provisions remain in full force.
25.3 No Waiver
- Yoko's failure to enforce any right or provision shall not constitute a waiver of that right or provision.
25.4 Assignment
- You may not assign your rights under these Terms without Yoko's prior written consent. Yoko may assign its rights in connection with a merger, acquisition, or sale of assets.
25.5 Language
- These Terms are drafted in English. The English version shall prevail in the event of any conflict between translations.
